Know your rights when you rent property in Spain

If you are looking for an apartment on the Costa Blanca to rent, you should know what your fundamental rights are as a tenant according to what is established in Spanish law.

If it is the first time you rent a house in Spain, you must know the most relevant aspects of the rent. In this article we summarize them:

How long can I stay for rent?

The duration of the lease will be freely agreed by the parties. If it is less than three years, the contract expires, it shall be extended for annual periods until the lease reaches a minimum of three years.

In the case mentioned above, the landlord can recover the dwelling after a year's rent if he needs it for him or his immediate family, but he must notify his tenant at least two months in advance.

If I leave before my contract expires, do I have to pay?

If the contract lasts less than three years, the contract may be canceled and leave the house after at least six months have elapsed, provided that it is communicated to the landlord at least 30 days in advance.

In some contracts there may be different conditions, including compensation, so it is convenient to read well what one signs.

Can the landlord enter the apartment once rented without my permission?

Can the landlord enter your rented house? No. What if you include a clause in the contract that says you give permission to enter? No. What if you want to come in to show the floor because you're about to leave? No. The landlord can only enter your apartment with your prior permission or with judicial authorization.

How often can the rent increase?

During the term of the contract, the rent can only be updated by the lessor or the lessee on the date of each year of effectiveness of the contract, in the terms agreed by the parties.
